SALES AGREEMENT

1. Individuals under 18 can not shop in Erksilver.

2. Erksilver accepts money orders. Orders will be cancelled if their money orders are not done in one week. The start time of processing the orders are not the moment that the order has been given but the moment that we receive the money order. Unspecified payment methods like cash on delivery or postal cheques are not accepted.

3. Erksilver will deliver all your orders along with a receipt attached by a dispatch list as the laws require. Gift packages will be sent with the delivery note and the bill will be sent to the billing address later. All prices in the shopping are stated in YTL. VAT percentage is 18%.

4. Erksilver is not responsible from the price anomalies resulted by typesetting or system errors.

5. Events that did not exist or foreseen on the agreement date, that develops out of control of the parties, that makes impossible for one of the parties or both parties to fulfill the debt or responsibilities owned by the agreement totally or partially or fulfill these on time will be deemed as force majeure (act of god, war, terror, rebellion, legislation rules, confiscation or strike, lockout, important malfunctionings at production or communication facilities, etc.). The party having the force majeur will inform the other party immediately in written. During the force majeur happenings, there will not be any responsibility caused by not fulfilling the actions. If the force majeur lasts 10 (ten) days, each party will have the right of cancellation ex parte.

6. Erksilver, unlike the all virtual shopping sites, do not store a stock for its hundreds of products that are being sold. It supplies the products as per the customer orders. Although the lists of all products are updated everyday, some products that have been ordered may not be available in our stocks. In this case, the related department will inform you via post and the blocked amount in your account for that product will be removed.

7. Delivery of a paid order is done via Aras Kargo, Yurtici Kargo, MNG Kargo and PTS Carrier companies if the destination is in Turkey. If not, the delivery is done via PTS Worldwide Express, International Postal Service or APS. Erksilver may change the cargo company to speed up the delivery when required. Average delivery durations: 1-2 weeks with a special cargo company.

8.In the case that your packages are delivered to you on time, the package can be tracked by calling the cargo company by us or by the customer. Once the package is delivered, the cargo company is deemed as successful in completing its task. During the delivery, if it comes out that the packages are damaged they should not be accepted and a written report should be taken. Then that written report should be sent to the fax number +90 312 427 08 58. Erksilver will re-supply the product and make the re-delivery as soon as possible.

9.Erksilver does not accept special orders.

10.The person who makes shopping in Erksilver is deemed as agreed on the above items.
